What is classified as a "Cyber
Crime" |

Answer |
Cyber Crimes are often defined as offences where a computer is either a
target or tool of the Offence. Here we are speaking of offences both under
a specific Cyber Crime legislation such as ITA 2008 or Computer Abuse Act
etc as well as general crime laws such as IPC or any other law.
A slightly different way of defining the Crime is to substitute the
word "Computer" in the above definition with "an electronic document" or
"Binary Expressions".
No definition will be completely satisfactory. It is better to
understand that Crimes in Cyber Space created by binary expressions may be
called Cyber Crimes. It may include crimes against devices that generate,
store or transmit binary expressions. (We use the term binary expression
here as synonymous with Electronic Documents' |

What are Cyber Crime Police
Stations? |

Answer |
In India some States have created specialized police stations to
investigate Cyber Crimes and tried to post trained personnel there to
handle the complexities of technology crimes. This was more relevant when
ITA 2000 required police officers of the rank of DSP and above only to
investigate the offences under ITA 2000. However when we consider all
crimes including those under other laws such as IPC committed with a
Computer or Mobile as "Cyber Crime" and also since ITA 2008 makes the
Inspector of Police the lowest ranked police official who can investigate
the offences under ITA 2008, need to have specialized Cyber Crime Police
Stations have become less and in some cases counter productive. However
until an effecive Police training programme ensures availability of
trained police officers in all Police Stations, the relevance of Cyber
Crime Police Stations may continue. |
